Account DataPersonal Data stored about the Customer that is required to successfully purchase a Clanview Product and create a Customer Self Service Account.

Clanview 

(“The Service”)

A suite of secure online web services that delivers the ability to automatically create, explore and share family history data as an interactive 3D model (“instance”) within a web browser.

Clanview is packaged and sold as different product variations, each product with its own features, conditions and charge(s).

Clanview Model

Specifically refers to the 3D model created using family history data supplied by the Creator.  This model allows the User to view selected family history information based on the Service Data supplied.

Clanview Product

(“Product”)

A product that can be acquired online that allows a Customer to acquire and use the Service.  There are 2 general categories of Clanview Products:

 – Subscription-based Clanview Product that requires periodic payment in advance on order to use The Service with varying access to features and Clanview Model limitations.

 – Free Clanview Product that allows use of The Service with various restrictions to features and Clanview Model limitations.

CookiesFiles containing small amounts of data that are stored on a User’s device when using an Internet browser.
Customer

The person that pays to acquire the Service.

Customer Self Service Account

(“Account”, “My Account”)

The online web-based account that a Customer logs into in order to view and manage information relating to their purchase, themself and their purchased Product(s).
Creator

The person that uses this data with the Service to automatically create a Clanview model.  The is assumed to be the researcher or “Author” that accumulates the family history research data.

DeviceThe personal computer or mobile device that the User is using to access the Service.

Family History Data

(“Service Data”)

Information collated and supplied by the Creator using a separate third-party genealogy application or online service.  This data is used by Clanview solely for the purpose of creating and exploring a Clanview Model.
User

Anyone using or accessing the Service including the Customer, Creator and people who receive and explore a Clanview Model.

Personal Data

(“Personal Information”,

“Personal Identification Information”)

Information about a living person that allows that person to be identified.

Introduction

Clanview (the “Service”) available at the clanview.com website is owned and operated by Streeton Tech Pty Ltd trading as Vicinity View (“us”, “we”, “our”).

Please read this Privacy Policy which forms part of the Terms Of Use (“Terms and Conditions”, “Terms of Service”, “Terms”) before using our Service.

By accessing or using the Service you agree to be bound by these Terms.  Acceptance and compliance with these Terms applies to anyone who visits, accesses or uses the Service.

Cookie UseCookies are small pieces of data sent between web servers and web browsers.  We use cookies in order to deliver important Service functions, such as providing secure Account access (i.e. a log in session) after logging in to My Account, as well as performing anonymous tracking of visitor activity when browsing our website.  You can instruct your web browser to refuse all cookies or to indicate when a cookie is being sent. However please be aware that, if you do not accept cookies, you may not be able to use some parts of our Service.

Collecting Personal Information

Note that “Collecting” data refers to the persistent storage of data on our servers.

Account Data

For Customers that sign-up for our Service, we collect the following data that may be perceived as Personal Information:

  • First Name
  • Last Name
  • Email Address
  • Billing Address

Service Data

In regard to the Service Data that is provided to create a Clanview Model, it is the Creator’s responsibility to ensure that this data excludes all Personal Information for living persons.

Using Personal Information

Account Data

This will only be used for necessary communications with the Account holder (such as sending Service-related offers or information, or providing support and assistance) or notifying the Account holder of changes to the Service that may impact them.

Service Data

Service Data is used solely for the purpose of providing the Clanview Service to Users.

Disclosing Personal Information

We will never intentionally disclose or share any Account Data or Service Data with any third parties with rare possible exceptions.

These exceptions include:

Disclosure for Law Enforcement
Under certain circumstances, Streeton TechPty Ltd may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements
Streeton Tech Pty Ltd may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of Streeton Tech Pty Ltd
  • To prevent or investigate possible wrongdoing in connection with the Service
  • To protect the personal safety of users of the Service or the public
  • To protect against legal liability
Retaining Personal Information

Clanview Service Data is retained until cancelled/deleted by the Creator.

Account Data is retained for the duration that the Account is active (i.e. the Account Holder has not requested that it be deleted).  Account Data will also be retained if necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Anonymous Activity Data is retained for longer periods of time for analysis purposes.

Personal Information Security

Secure transfer and storage of your data is very important to us.  All communication of data occurs over encrypted point-to-point HTTPS.  Data is stored securely on our servers using industry-standard infrastructure involving multiple security measures.  In addition, every effort is taken to mitigate any possible risk of data disclosure, by disallowing storage of personal identification data for living persons.  See Terms Of Use for more information.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data to the United States and process it there.  Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.  Note that this data is used strictly and solely for the purpose of delivering Clanview Services only, as stipulated elsewhere in this Privacy Policy and in the Terms Of Use.

Access to your Personal Information

A Clanview Customer is automatically provided access to a self-service online Account that facilitates access to and management of their personal information held in their Account.

Any other User is able to contact us at any time to requesting viewing, modifying or deleting any of their Personal Data from Family History Data.  Note however that Terms of Use require that such personal identification data should never be supplied by the Creator for other living persons.

Children’s Privacy

Signing up for our Service (involving Account creation and payment) does not target children younger than 13.

Our Service is intended for adults to purchase, sign-up and supply suitable Service Data that they deem acceptable to share with intended trusted recipients in the form of a Clanview Model.

We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

Changes To This Privacy Policy

We reserve the right to update our Privacy Policy at any time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email prior to the change becoming effective and update the date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
